TERMS AND CONDITIONS
“DESPERATE HOUSEWIVES PROMOTION”
These terms and conditions govern entry into the “Desperate housewives promotion” (“Promotion”) organized by Yoplait UK Limited, Saint Andrew’s House Portsmouth Road, Esher, Surrey, KT10 9SA. In order to administer the Promotion, Yoplait may make use of advertising and promotional agencies and other service providers. Yoplait reserves the right to modify these terms and conditions at any time prior to, during or after the Promotional Period.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING.
1. Information on how to enter and prizes form part of these terms and conditions. By participating in the Promotion, participants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid.
2. Entry is open to residents of the United Kingdom aged 21 years and over. Employees and their families of Yoplait and its subsidiaries, agents, affiliates, representatives and any other person assisting with the Promotion are ineligible to enter.
3. The Promotion commences at 00.01 on 01/11/2011 and closes at 23.59 on 31/03/2012 (“Promotional Period”). Entries received after the Promotional Period will be invalid.
4. To enter the Promotion, participants must visit www.yoplait.co.uk and register for the Promotion as set out on the website. No other form of entry will be accepted. Only one entry per person is permitted. Additional entries will be disqualified and only the first entry received will be eligible.
5. Use of computer programs and automated means of entry are prohibited and entries by such means, or via third parties, will be disqualified.
6. A prize draw for the Promotion will take place on 05/04/2012 and will be overseen by an independent observer. The first valid entry drawn will win the trip to Hollywood. The next 25 entries drawn will each win one runner-up prize. The winner and runners-up will be determined at random from all eligible entries. Yoplait’s decision concerning the determination of the winner and runners-up will be final and binding.
7. The prize winner and runners-up will be notified by email and/or telephone on or before 30th April 2012. If no response is received within a 7 days of notification, Yoplait will take reasonable steps to contact the winner and/or runners-up again. If the winner and/or runners-up are not able, for whatever reason, to accept their prize or fail to claim their prize within 14 days of the date they were first notified of their prize, then Yoplait reserves the right to award the prize to another participant.
8. There is one main prize consisting of: Return flights from London to Los Angeles, return airport to hotel transfers, 4 nights/5 days at the Standard Hotel, the chance to see where Desperate Housewives is shot on location, the discovery of Beverly Center and its shops, a dinner for two at Spago’s in Beverly Hills, a movie star homes tour and travel insurance. The prize does not include anything not detailed above, including, without limitation, any spending money or taxes which may be payable as a consequence of receiving the prize. The prize is subject to the terms and conditions of any third party service providers used to supply the prize, including but not limited to the below:
a. Dates of travel are 15th May – 23rd July 2012 excluding the following period: 2nd June – 10th June 2011
b. Prize is subject to availability with no cash alternative, and is non-transferable and non-refundable.
c. Prize is based on 2 people traveling.
d. Flights are economy class, departing from London.
e. Return airport transfers in Los Angeles included.
f. Standard Hotel accommodation for 4 nights/5days and based on 2 people sharing 1 room.
g. Trip to Desperate Housewives location will be in an air-conditioned Starline Mini-Bus And a trip to Beverly center with a tour of Hollywood’s movie star home.
h. All those traveling must have valid passports and applicable Visas/permissions and are responsible for online registration of the US Immigration ESTA. https://esta.cbp.dhs.gov/. All fees related to passports, visas and ESTA submissions are to be paid at the winner’s expense.
i. Both people traveling must be over 21.
j. A credit card or cash deposit for incidentals will be requested by the hotel at check in.
k. Travel insurance will be included.
l. Any potential winner and their proposed guest will be required to sign a prize acceptance and release form in order to be eligible to win and/or participate in the prize.
9. There are 25 runner-up prizes, each to consist of one standard definition DVD of Desperate Housewives Season 7. These prizes will be sent via recorded post within 30 days after the announcement of the winners.
10. By accepting a prize, to the fullest extent permitted by applicable law, the prize winner, his/her guest and the runners-up consent that Yoplait may use their name, photograph, likeness (including his/her voice), hometown and biographical information and statements concerning the Promotion or Yoplait’s products without further compensation or notice for the purpose of advertising, promotion, and merchandising, and the prize winner, his/her guest and the runners-up grant all rights to edit or modify and to publish and copyright such details.
11. Cash or credit alternatives are not available in whole or in part.
12. The prizes are non-refundable and non-transferable, except at the reasonable discretion of Yoplait. Any decision made by or on behalf of Yoplait in connection with the Promotion will be final and binding. No correspondence will be entered into.
13. Yoplait will take reasonable care to ensure that prizes are as described in these terms and conditions. However, Yoplait reserves the right to substitute a reasonably equivalent of like value in the event that a prize (or any part thereof) is unavailable for any reason whatsoever and the prize winner and runners-up agree that no liability shall attach to Yoplait or any party connected to the Promotion as a result of any such substitution.
14. Ineligible, incomplete, inaccurate or fraudulent entries will be disqualified. Yoplait reserves the right to disqualify any person who is involved in interfering or tampering with the conduct of the Promotion in any way. All participants will be deemed to have authorized Yoplait to check the completeness and accuracy of the information they provide.
15. Yoplait shall not be liable for any loss, damage or injury suffered as a result of participation in the Promotion and/or accepting or using the prize (or any part thereof), except for liability which cannot be excluded by law. In particular, nothing in this clause shall exclude liability for death or personal injury resulting from negligence on the part of Yoplait or any other loss where to do so would be unreasonable in all the circumstances.
16. Yoplait assumes no responsibility for any failure to receive an entry on account of postal delays, technical or connectivity problems, congestion on the internet or on any website, any inaccurate information submitted as part of an entry or any loss, damage or injury suffered as a result of technical problems or otherwise. Proof of posting, entering information on a website, sending an email or use of any other permitted submission method does not constitute proof of delivery or receipt of such entry and associated information. Yoplait may at any time modify, cancel, terminate, suspend or extend the Promotion without liability (to the maximum extent permitted by applicable law). Warner, acting reasonably, also reserves the right to delay the timing of the notification to the prize winner.
17. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the Promotion, participants agree to release Facebook from any and all liability connected with the Promotion.
18. In order to participate in the Promotion, participants will be required to supply certain information about themselves in their entry. You understand that you are providing your information to Yoplait. Yoplait has specified which information is mandatory in order to participate in the Promotion. Personal data from entries will be collected and used by Yoplait for the purpose of conducting and administering the Promotion including publicizing the names of prize winners. By entering the Promotion, participants expressly consent to the specific use of their personal data as described in accordance with these terms and conditions and agree that Yoplait may use this data, or disclose it to other organizations that may use it, for such specific purposes without any further reference, payment or consent. Such information may also be used by Yoplait in relation to the general marketing of its products and services, including via email, if a participant has expressly consented to such use. Participants agree that all or part of their data may be transferred to and/or processed in the United States of America where privacy may not provide the same protections as within the UK/EU, for any or all of the purposes specified in this clause.
